General Terms and Conditions - Nagelcentrum Marjolijn


1. Applicability

These general terms and conditions apply to all transactions concluded online with MaTiBe BV via www.NagelcentrumMarjolijn.be and in our physical store. By using this website, you agree to these general terms and conditions. All agreements are subject to and interpreted in accordance with Belgian law. Furthermore, all disputes between us will be exclusively resolved by the Belgian courts. Nothing in these general terms and conditions will be deemed to affect your statutory rights.

2. Definitions

• The company/we/us/our: MaTiBe BV

• The customer: The person or business entity that purchases or agrees to purchase goods from the company.

3. Prices

All prices are in euros. All prices are exclusive of VAT. Prices can be changed without prior notice.

4. Orders

Orders can be placed via the website and in our physical store. Payment can be made via credit card, Bancontact/Mister Cash, KBC-Betaalknop, Belfius Pay Button, ING Home Pay, and iDEAL. Cancellations after placing an order are possible, but an administrative fee of 5% of the total order amount, with a minimum of €5.00 and a maximum of €15.00, will be charged.

5. Payment Terms

All transactions are subject to validation checks and approval by the card issuer. We cannot be held responsible for delays or non-delivery due to payment issues. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.

6. Delivery & Shipping

Ordered products are delivered according to the chosen delivery method. The maximum delivery time is 60 days. If a product is out of stock, we may decide to cancel the order and refund in the form of a refund or credit. We do our best to ensure you receive your order within the estimated delivery time.

Damage upon delivery must be reported within 24 hours of receipt. We are not responsible for delays caused by the carrier.

For standard orders in Belgium, the shipping cost is €6.95 (excl. VAT) for orders under €100 (excl. VAT). In the Netherlands, the shipping cost is €8.95 (excl. VAT) for orders under €100 (excl. VAT). For orders above this amount, we will cover the shipping costs.

Please note: During discount events and promotions, different conditions apply for covering the shipping costs. During these periods, we will only cover shipping costs for orders over €149 (excl. VAT) for both Belgium and the Netherlands.

7. Right of Withdrawal and Returns

Nagelcentrum Marjolijn operates exclusively as a B2B wholesaler and sells to professional customers. All purchases through our webshop are considered business transactions, regardless of whether the customer provides a VAT number. This means that the statutory consumer right of withdrawal (14-day return without reason) does not apply.

However, we understand that there may be exceptional cases where a return is necessary. Therefore, we have the following return policy:

Return Possibilities: If a product is unused and fully sealed, it may be returned under the following conditions:
• The product is in an unused, fully sealed, and unopened state.
• The return is requested within 7 days of receipt.

Exceptions – Non-Returnable Products: Some products cannot be returned, as they do not have a protective seal and cannot be resold for hygienic or safety reasons. These include:
• Base and top coats, BIABs, builder bases, gel polishes, pigments, glitters
• Drill bits, files, brushes, cuticle nippers, pushers
• Hand creams, liquids, and other care products

Note: Some products, such as specific drill bits (e.g., Staleks), files, or tools, do have a seal or individual packaging. In these cases, a return is only accepted if the seal is completely intact.

Return Costs

• Full return of an unopened order (in original, sealed packaging): an administrative fee of €10 will be deducted from the refund. This covers processing, packaging, and shipping costs.
• Return of a single product: No additional costs apply, unless the free shipping threshold is no longer met. In that case, shipping costs will be charged.

Returns for Errors or Damage: Returns due to manufacturing defects or incorrect delivery are, of course, free of charge. These cases must be reported within 24 hours of receipt:
• Products with a manufacturing defect or damage upon delivery.
• Incorrectly delivered products.

8. Warranty

Nagelcentrum Marjolijn operates exclusively as a B2B wholesaler and sells to professional customers. This means that our warranty conditions apply within a business context and do not fall under consumer legislation. However, we strive to provide fair service and are happy to work with you to find a solution in case of issues.

Product Warranty

• We offer a minimum warranty of 6 months against manufacturing defects, starting from the invoice date.
• The exact warranty period may vary depending on the manufacturer and product.
• Defects caused by misuse, negligence, accidents, external influences, or normal wear and tear are not covered under warranty.

Warranty Procedure

• Report a defect within 7 days of discovery by email at info@nagelcentrummarjolijn.be.
• Provide a clear description and photos of the defect.
• We will assess the situation together: depending on the issue, the product may be repaired, replaced, or partially refunded.

Exclusions from Warranty

• Damage due to misuse, such as improper storage (e.g., exposure to heat, sunlight, or frost), incorrect opening, or improper use of electrical devices.
• Normal wear and tear from repeated professional use.

We understand that a product may sometimes wear out faster than expected. Even if an item falls outside the warranty, we are happy to work with you on a reasonable solution. This could include repair, a discount on a replacement product, or another form of compensation, depending on the situation.

9. Force Majeure

We are not responsible for non-performance due to force majeure, such as natural disasters, riots, flooding, fire, strikes, lock-outs, or legislation.

10. Complaints

Complaints can be reported via info@nagelcentrummarjolijn.be. We aim to handle complaints within 5 working days.

11. Security

Our website uses SSL technology for secure transactions. All data is fully encrypted.
